These Terms of Service (“Terms”) govern your use of the website at https://pageguard.com and any related services (together, the “Services”) provided by Lashmire LTD, trading as Page Guard (“we”, “us”, “our”).
By accessing this website or using our Services, you agree to these Terms. If you do not agree, you must not use this website or our Services.
We may amend these Terms at any time. Where changes materially affect your rights as an existing customer, we will give you at least [30 days’] notice before the changes take effect. Continued use of our Services after that point means you accept the updated Terms.
Page Guard provides ongoing website management services, including but not limited to: website hosting, security monitoring, malware protection, backups, performance optimisation, search engine visibility support, and website changes requested by the customer, as set out on our Pricing page at the time of purchase.
We offer two main services:
The exact scope of what’s included in each service is set out on our website at the time you purchase, and may be updated from time to time. We’ll always honour the scope that applied when you signed up, for the duration of your current billing period.
Our subscription plan is designed around the following usage limits, based on typical website needs:
Our Services are built for and only support WordPress websites. We do not currently support websites built on other platforms or content management systems.
Our Services do not support e-commerce websites (including websites with shopping carts, payment processing, or online stores).
If your website exceeds these limits, uses a platform we don’t support, or is an e-commerce site, please contact us before signing up so we can advise whether we’re able to support it, and on what terms. Where a website exceeds these limits after sign-up, we’ll notify you and may apply an additional fee to cover the extra storage, traffic, or developer time involved, calculated in line with our then-current pricing.
Our subscription plan includes unlimited website changes and support requests, subject to fair and reasonable use. This means:
If we believe your use of the Service is unreasonable under this policy, we will contact you first to discuss it before taking any action.
By using our website or Services, you agree that you will not:
We reserve the right to suspend or terminate access to our Services, without refund, for any breach of this section. Where practical, we’ll give you a warning and a chance to correct the issue first, except in cases of abuse, threats toward our staff, or fraud, where we may act immediately.
If you cancel your subscription, stop paying, or wish to move your website away from us, you can transfer your website yourself using the backups made available to you within our system, at no cost.
If you would like us to carry out the transfer on your behalf, a transfer fee of £200 per website applies, covering the administrative and technical work involved. This fee is payable in advance of the transfer being carried out, and applies separately each time a transfer is requested. We may revise this fee with notice to you.
Content and materials on this website, excluding content you provide to us, are owned by or licensed to Lashmire LTD and protected by copyright and trademark law. We grant you a limited, non-exclusive licence to view and use this website for your own personal or business purposes. This licence does not transfer ownership, and may be terminated if you breach these Terms.
Your website and content. Any content, copy, images, or branding you provide to us, or that we create for you as part of building or maintaining your specific website, belongs to you. We do not claim ownership over your website’s content or brand.
Our tools and systems. Any underlying software, templates, tools, or systems we use to deliver our Services remain our property, or that of our licensors, and are not transferred to you as part of the Service.
Our Services and this website are provided on an “as is” basis. To the extent permitted by law, we make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, or non-infringement.
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud.
Subject to the above, our total liability to you for any claim arising from these Terms or our Services, whether in contract, tort, or otherwise, is limited to the total fees you paid us in the [3 months] immediately before the event giving rise to the claim.
We are not liable for any indirect or consequential loss, including loss of profit, revenue, business, goodwill, or data, arising from your use of our Services, except where such loss results from our failure to carry out the Service with reasonable care and skill.
Because some jurisdictions do not allow certain limitations on liability, some of the above limitations may not apply to you.
Content on this website is provided for general information purposes and is not exhaustive. We do not warrant the accuracy, completeness, or reliability of material on this website, or on any external site we link to.
We are not responsible for the content of any third-party website linked from ours. A link does not imply our endorsement of that site. Visiting linked sites is at your own risk.
The following are outside the scope of our Services, and we do not provide support for:
We’re happy to recommend a specialist for any of the above where we can.
We process personal data in accordance with UK data protection law, including the UK GDPR. Details of what data we collect, why, and how you can exercise your rights are set out in our Privacy Policy.
We may suspend or terminate your access to our Services, with written notice, for any material breach of these Terms. Where the breach involves abuse, threats, fraud, or a serious security risk, we may suspend access immediately and notify you afterward.
You may terminate your agreement with us at any time in accordance with Section 5 (Payment, billing, and cancellation).
Severance. If any part of these Terms is found to be void or unenforceable, the rest of these Terms remain in effect.
Governing law. These Terms are governed by the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales.
Entire agreement. These Terms, together with our Privacy Policy and any order confirmation you receive, form the entire agreement between you and us regarding our Services.
